Vigilantism

PC-1-12

Description: Engaging in the duties or actions of law enforcement without possessing the legal authority to do so. This includes unlawfully detaining, arresting, punishing, or claiming to enforce laws against other individuals under the pretense of justice.

Classification: Misdemeanor

Fine: $100

Sentence: 10 months

Key Points:

  • Vigilantism is not the same as a legal citizen’s arrest. A citizen’s arrest must be based on direct observation of a serious crime and turned over immediately to law enforcement.

  • Performing any act of justice or punishment without authorization from a legal entity (police, courts) is a violation of this code.


Examples of Vigilantism:

  • Detaining or “arresting” someone for breaking a law, without legal authority.

  • Claiming to charge someone with a crime as if acting in an official capacity.

  • Enacting physical punishment or public shaming in response to a perceived offense (e.g., handcuffing someone to a pole for slapping another person).

  • Conducting unauthorized patrols and attempting to enforce laws through threats or force.
