Aiding and Abetting / Accessory to Crime

Description: Knowingly providing assistance, support, or encouragement to an individual committing a criminal act. This includes—but is not limited to—offering financial aid, transportation, tools, weapons, advice, or any form of logistical support that furthers the commission of a crime. The individual does not need to be present at the scene of the crime to be charged under this section.

Important Clarifications:

  • This charge does not include Harboring a Fugitive (i.e., knowingly hiding or sheltering someone actively fleeing law enforcement).

  • This charge does not include Criminal Conspiracy (i.e., the prior act of planning or agreeing to commit a crime).

  • This charge may stack with other applicable charges, depending on the role and level of involvement.


Examples:

  • Acting as a getaway driver during or after a robbery.

  • Lending a weapon or equipment to someone knowing they intend to commit a crime.

  • Providing real-time updates to a suspect about police movements during a pursuit.
