Reckless Endangerment

PC-1-5

Description: Engaging in behavior that demonstrates a blatant disregard for the safety of others and creates a substantial risk of serious physical harm. The accused does not need to have intended harm—only to have acted recklessly in a way that any reasonable person would recognize as dangerous.

Misdemeanor Reckless Endangerment

Classification: Misdemeanor

Fine: $100

Sentence: 10 months

Felony Reckless Endangerment (With a Deadly Weapon)

Classification: Felony

Fine: $200

Sentence: 20 Months

Examples of Reckless Endangerment:

  • Firing a weapon into a crowd or in a populated area.

  • Throwing objects (e.g., rocks) from a bridge or rooftop onto vehicles or pedestrians.

  • Engaging in high-speed racing or stunt driving on public roads.

  • Setting off fireworks in a dense residential or commercial area.
