Animal Cruelty

PC-1-13

Description: Maliciously or intentionally harming, wounding, or killing an animal without lawful justification. This includes acts committed outside of regulated hunting activities and excludes cases involving self-defense or the defense of another person or domesticated animal.

Key Clarifications:

  • This law does not apply to insects or rodents.

  • This law does not apply when the act is committed in reasonable self-defense, or in defense of another person or pet.

  • Lawful hunting and livestock practices conducted under proper regulations are not covered by this charge.


Examples:

  • Beating or shooting a pet or domestic animal without provocation.

  • Running over an animal intentionally with a vehicle.

  • Setting traps with the intent to injure or kill animals for amusement or retaliation.
