Description: Engaging in unwelcome and inappropriate sexual remarks, gestures, or physical advances toward another person in a workplace, professional, public, or social setting. This charge applies when behavior is unsolicited, offensive, and creates an uncomfortable or hostile environment.

If a person touches the intimate parts of another individual who is unlawfully restrained by the accused or an accomplice—and such contact is against the victim’s will and intended for sexual arousal, gratification, or abuse—the offender is guilty of a more serious crime and may be charged accordingly (e.g., Sexual Battery, Assault, or Unlawful Restraint depending on the situation).
