Threats Against an Elected Official

Description: Making, posting, or otherwise communicating a threat—whether verbal, written, or digital—against an active elected official, with the intent to cause harm or with the perceived ability to carry out such a threat. This includes any form of planning, encouragement, or attempt to intimidate an official through the threat of violence.

Applies To:

  • Mayors, city council members, judges, sheriffs, governors, or any other individual currently holding elected public office.

  • Threats made in person, through phone calls, text messages, emails, or via social media platforms.

Important Note: A credible threat must demonstrate the intent to intimidate, harm, or disrupt the duties of the official. Even if the threat is not ultimately acted upon, the existence of a clear intent and perceived ability to follow through is sufficient for this charge.
