Description: The unlawful act of breaking out of, or breaking into, any secured detention facility, jail, or prison with the intent to escape custody or facilitate the escape of another. This includes aiding in a jailbreak, damaging security systems, or exploiting entry points in detention zones.

Key Points:

  • Applies to inmates escaping custody, as well as outside parties breaching security with intent to assist.

  • Time served prior to escape is not counted toward the new sentence—original time is reinstated in full.

  • Any damage to property, assault on personnel, or use of deadly force during the escape may result in additional charges (e.g., attempted murder, destruction of government property).


Examples:

  • Climbing a prison wall or fence to escape custody.

  • Smuggling tools or weapons to an inmate with intent to aid their escape.

  • Using a vehicle or helicopter to break into a prison yard for extraction.
