Impersonating a Police Officer

Description: It is unlawful for any individual to willfully wear, display, or use the official uniform, badge, insignia, identification, or other markings associated with a peace officer with the intent to deceive others into believing they are a law enforcement official. This also includes using red/blue/amber lights, sirens, or law enforcement-style equipment to attempt or succeed in detaining, stopping, or influencing another individual, especially on public roadways.

Examples of Violations:

  • Dressing in a police uniform and patrolling a neighborhood as if on duty.

  • Flashing fake police credentials or a badge to intimidate or influence others.

  • Equipping a civilian vehicle with red/blue lights and using them to stop another motorist.

  • Wearing official police attire and threatening to arrest someone without lawful authority.


Valid Legal Defenses May Include:

  1. Lack of Intent to Defraud: No intent to mislead or gain benefit from impersonation.

  2. Theatrical or Filmmaking Use: Clearly used as a costume for a production, with no attempt to mislead the public.

  3. No Act of Impersonation: Merely possessing law enforcement-style clothing or items without engaging in impersonation.
